Demographically, Kashmir, the northern and eastern portion of Jammu, and the Kargil District of Ladakh should be apart of Pakistan since they have a Muslim majority.
Legally, India (though this too is debateable) due to the international law concept of territorial continuity, in that the borders of a state can only be changed via agreement, and not through conquest. JK as a princely state acceded to India, however one could argue this was under duress, but that the duress was brought on by, or at leasy supported by Pakistan. However if one argues JK legally joined India, then they should concede that Junadagh should legally be apart of Pakistan, as its ruler opted to join them over India.
When the pakistan invaded kashmir, the indian army repelled the pakistanis and was so close to overruning all of kashmir. But the prime minister was an idiot and stopped the advance because he wanted the UN to decide on the issue. Even worse, his plans were to disband the indian army after independence, and only the kashmir war stopped those plans. That's the most aggravating part of the issue for me.
