In most cases it'd comparable to a hiring a lawyer for a small claims case, the ones that stretch out with constant appeals are for the uber rich with massive disputes and even then they stand to gain a lot more than the legal fees they're risking. Even if it was expensive anyone that's doing it has gains that far outweigh the legal fees.
