The Franks were initially a confederation of various tribes with vague similarities like being of Germanic origin, and after they spilled into the old Roman territories they drew forces from other federated and native Gallo-Roman subjects. When Clovis was fighting the Alemanni, his "Franks" would be compromised of Goths, Bretons, Alans, Romans, Huns and all other peoples he could muster, and they all were "Franks" due to their political allegiance.
No. The Franks did have ethnic laws, and even ethnic law codes. The Burgundians, Romans and Alemanni lived under their own law codes, by the time of Charlemagne all these people were part of the Frankish Regum, but they were not Franks and not treated as such. When Charles (Uncle of Charlemagne) destroyed the Alemanni and all their independent power crushed they were integrated into the Frankish system, but they were distinctly not Franks although being a rather privelaged compared to the other peoples such as Burgundians and Vascons who were completely exluded from the privelage of being made Count in the Carolingian Kingdom.
Even Roman elites kept their own Roman identity and culture. They still existed and often held important lesser posts but not one ever became a Count. They were deliberately exluded from the rule of state since they were not Franks themselves and did not consider themselves to be as such. Some military units were to be exlusively Frankish such as the antrustiones which only in the 8th century allowed other ethnic groups in. Chronicles like Fredegar's Continuer directly state Romani as an ethnic group (likely from their legal ethnic identity) as being seperate from the Franks.

Nowhere near. In Italy the Senate was still a powerful institution. While they were once and for all cut out from all military power they were still very much running the civil service in Ostrogothic Italy, even taking part in who the next King would be. Which ended up getting quite a few Senators executed for doing, since it implied treason to speculate on the next Emperor or King, one of the most notable killed in the purge being Boethius.
In Frankia the Roman aristocrats generally worked with the Frankish Kings up until their dissaperance in the 8th century. They played the part as much as any other Frankish magnate, suppling men and taxes to the King and they in exchange got a seat at the table when a royal council convened. The supreme command of the naval forces and Charles Martel was even given to a Roman aristocrat. The other regions of the former Empire I don't quite know
